Projeto de Lei de Adiantamento Tramita na Câmara de Búzios

Tramita na Câmara de Búzios o projeto de lei que altera o regime de suprimento de fundos por meio de adiantamento na Administração Pública Municipal.(Acesse https://sapl.armacaodosbuzios.rj.leg.br/materia/1376)

O regime de Adiantamento consiste na entrega de valor a servidor da Administração Pública Direta e Indireta, devidamente credenciado pelo órgão requisitante, para realizar pequenas despesas de pronto pagamento, que por sua natureza ou urgência, não possam aguardar o processo normal.

Conforme o projeto, só poderá ser concedido adiantamento com empenho prévio e para despesas extraordinárias ou urgentes e despesas miúdas e de pronto pagamento. Em casos excepcionais, devidamente justificados pelo requisitante e mediante expressa autorização do ordenador de despesa, poderá ser concedido adiantamento para aquisição de bem permanente destinado ao atendimento de situação que se enquadre como extraordinária ou urgente.

Os adiantamentos concedidos ficam limitados a 2 servidores por órgão ou entidade, totalizando no máximo 12 concessões em cada exercício por órgão ou entidade. Esses limites só poderão ser ultrapassados com autorização expressa do Gabinete do Prefeito. O valor máximo para concessão será de até R$ 8.800,00.

O portador de adiantamento deve apresentar a comprovação das despesas dentro do prazo de 30 dias contados da data indicada para sua aplicação ou do recolhimento do saldo, se houver, sujeitando-se a tomada de contas, descredenciamento automático e a cobrança de multa, se não o fizer.

Se aprovada, a proposta também revogará a Lei nº 69, de 8 de junho de 1998, que dispõe sobre a matéria. O PL 07/2021 - de autoria do Poder Executivo - foi encaminhado à Comissão de Constituição, Justiça e Redação na quinta-feira (18/02).
